I think if you go in and ask for certificate you will get your money back. If she has any sense she will then give you the tortoise. If she refuses, I would contact your local wildlife police officer - the local police station will advise.

I wouldn't worry about your own situation. You went back and asked for the certificate and when the woman refused to give you one, you asked for your money back.

Sorry to read about this Claire You obviously have this little torts best interests at heart, and she so needs a bit of proper care. I would say that the majority of people are completely unaware that they require a A10 certificate simply because DEFRA over complicate the information they give out (not that they really give any out as such). It needs to be simplified to the extent that there is no one out there who doesn't know. Everyone knows you need a licence to drive a car and a licence for your telly. DEFRA should do whatever it takes to make everyone aware that a certificate is required for a mediterranean tortoise.

A certificate is not required if you give the tort away for free but really that is daft and just causes the problems of torts being given away then maybe later sold on without a certificate. If a car is given away free a registration document is still required and if it was the same with a tort and everyone was completely aware of that then I don't think we'd see the same problems as we see every week of people not knowing. Even shops don't always know the rules, we see it all the time, bought from shop, no certificate or wrong species, wrong age, wrong certificate etc

I have spoken to her and she doesnt have the certificate so do i take her back and get my money back even though she has not been looked after and housed properly or keep her?
